1. About these terms
These terms are between you and Vyoma Logistics Pty Ltd (ABN 59 703 610 511, ACN 703 610 511) ("we", "us", "our"). They apply to your use of vyomalogisticstec.site and to any services we agree to arrange for you. By using the website or engaging us, you accept these terms.
2. Using this website
The information on this website is general in nature and is provided to describe our services. We take care to keep it accurate, but it does not form an offer or a quote. You must not use the website in a way that is unlawful, that interferes with its operation, or that attempts to gain unauthorised access to any system.
3. Quotes and services
Each job is based on a written quote or scope that we confirm with you by email. A quote is based on the information you provide and may change if the goods, quantities, locations, timing or handling requirements differ from what was described. Any specific terms set out in a confirmed quote apply in addition to these terms; if they conflict, the confirmed quote prevails.
Delivery times are estimates unless we expressly agree otherwise in writing. We will keep you informed of any delay we become aware of.
4. Your responsibilities
You agree to:
- give us accurate and complete information about the goods, including size, weight, value and any special handling needs;
- ensure goods are suitably packed and labelled for transport and storage;
- declare any dangerous goods before we arrange their movement; we may decline to arrange transport of goods we are not able to handle lawfully or safely;
- only ask us to move or store goods that you are lawfully entitled to deal with; and
- pay our invoices by the due date stated on them.
5. Third-party providers
We arrange services through independent carriers, couriers and warehouse operators. Those providers may have their own terms and conditions, including limits on their liability for loss of or damage to goods. We will tell you about any such terms that are relevant to your job. If your goods need insurance cover beyond what a provider offers, please let us know before the job is booked.
6. Australian Consumer Law
Our services come with guarantees that cannot be excluded under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)). These include guarantees that services will be supplied with due care and skill, will be reasonably fit for any purpose you have made known to us, and will be supplied within a reasonable time.
Nothing in these terms excludes, restricts or modifies any right or remedy you have under the Australian Consumer Law or any other law that cannot lawfully be excluded.
7. Limitation of liability
To the extent permitted by law, we are not liable for any indirect or consequential loss, including loss of profit, revenue or business opportunity, arising from the use of this website or our services.
Where our services are not of a kind ordinarily acquired for personal, domestic or household use, and the law allows us to limit our liability for a failure to comply with a consumer guarantee, our liability is limited, at our option, to supplying the services again or paying the cost of having them supplied again.
8. Intellectual property
The content, text, layout and graphics on this website are owned by or licensed to Vyoma Logistics Pty Ltd. You may view and print pages for your own reference, but you must not copy, reproduce or republish any part of the website for commercial purposes without our written permission.
9. Privacy
We handle personal information in accordance with our privacy policy.
10. Termination
Either party may end an ongoing arrangement by giving written notice by email. You remain responsible for paying for services provided, and costs reasonably incurred, up to the date of termination, including any job already in transit. We may suspend or end services immediately if you breach these terms in a material way, including by failing to pay an invoice when due. Clauses that by their nature should continue, such as those on liability and intellectual property, survive termination.
11. Governing law
These terms are governed by the laws of Victoria, Australia. Each party submits to the non-exclusive jurisdiction of the courts of Victoria and the courts entitled to hear appeals from them.
12. Changes and contact
We may update these terms from time to time. The version published on this page applies from the date shown above; changes do not affect a job already confirmed in writing.
Questions about these terms can be sent to ceo@vyomalogisticstec.site.
